Unified Terms and Conditions Agreement for LeadGen Accelerator: Full-Stack Platforms & Expert Consulting Monthly/Annual Services
By proceeding with checkout and completing your purchase, you, the Client, acknowledge and agree to the terms outlined in this agreement. This agreement applies to the purchase of LeadGen Accelerator: Full-Stack Platforms & Expert Consulting Monthly/Annual B2B Outbound Lead Generation services provided by S Collective Corp ("Agency").
Services Provided
The Agency agrees to provide the following services based on the specific plan selected by the Client:
LeadGen Accelerator: Full-Stack Platforms & Expert Consulting Monthly/Annual Access
- Mailead: Cold email automation software with unlimited cold emails per month allowed, and unlimited email accounts, warm-up, and active leads.
- ReachInbox: Cold email automation software with a limitation of 30,000 emails per month per subscriber, including unlimited email accounts, warm-up, and active leads.
- Aimfox: LinkedIn outreach automation software enabling automated connection requests and messaging sequences across two LinkedIn accounts.
- Notch: E-signature software for secure contract signing.
- Blue: Project Manager/CRM software with unlimited team member access.
- TaskMagic: Task Automation Software (unlimited members) to automate manual tasks and workflows for your team.
- SheetMagic: Google Sheets AI Software (5 members) for enhancing data management within Google Sheets.
- AnyChat: Multi-Channel Customer Communication Software for real-time chat, voice, and video integration into one platform for seamless customer interaction.
- Unum: Social Media Management Software to store, schedule, and automatically post content across multiple social media platforms.
- Training resources for using the systems independently and driving results.
- Email support to ensure the Client’s success.
Weekly Community Calls Policy
Weekly Community Calls are included as part of the service to enhance the Client’s experience. However, the schedule, frequency, and availability of these calls are subject to change at the Agency’s discretion. While the Agency strives to provide these calls consistently, they may be modified, rescheduled, or discontinued without prior notice.
Money-Back Guarantee
The Agency offers a 7-day money-back guarantee for LeadGen Accelerator: Full-Stack Platforms & Expert Consulting Monthly and Annual plans. The Client may request a refund and terminate the agreement within 7 days of starting the service. Refunds will be issued for the total amount paid, minus a 10% fee to cover processing costs.
This guarantee applies only to the first billing cycle and is not available for subsequent billing cycles, regardless of when they occur. Refund requests must be made within the first 7 days from the initial service start date. Access to the provided software or service will be canceled upon granting a refund.
If the selected offer includes a free trial, the money-back guarantee does not apply, as the Client has already had the opportunity to evaluate the service during the free trial period.
Pricing Models and Payment Terms
- LeadGen Accelerator: Full-Stack Platforms & Expert Consulting Monthly Access: $99 per month, billed automatically. The service renews month-to-month and may be canceled at any time before the next billing cycle without penalty.
- LeadGen Accelerator: Full-Stack Platforms & Expert Consulting Annual Access: $999 for a full year, billed as a one-time fee. The service will automatically renew annually at the same price unless canceled prior to the renewal date.
Cancellation and Refund Policy
This policy applies to all recurring subscriptions for LeadGen Accelerator: Full-Stack Platforms & Expert Consulting Monthly or Annual services. It is solely the Client’s responsibility to cancel their subscription, including during any free trial period, before the renewal or billing date if they wish to avoid charges. Cancellations must be made before the renewal date for monthly or yearly services to prevent additional charges.
Failure to cancel on time, for any reason, will incur a 10% processing fee based on the amount paid for the new billing cycle if a refund is requested. Refunds for failure to cancel before the new billing cycle can only be requested within 24 hours of a recurring charge. After this 24-hour window, no refunds will be issued for the new billing cycle.
Additionally, if the incorrect service is chosen and paid for, whether it is LeadGen Accelerator: Full-Stack Platforms & Expert Consulting Monthly, Annual, or any other service, a 10% fee will be charged when providing the refund to compensate for processing fees.
If the Client is subscribed in any manner that does not allow them to log in to the provided platform to manage their payment account, including the ability to cancel their subscription independently, they must send an email to juan@s-collective.com at least 48 hours before their subscription renewal date to request cancellation. If the Client wishes to cancel after the subscription has been renewed, they must email the same address within 24 hours of renewal. Cancellations requested within 24 hours of renewal will be eligible for a refund, minus a 10% processing fee.
If the client is subscribed under a free trial and the card does not auto-process successfully upon the payment date, S Collective reserves all rights to remove the service without notice.
Client Authorization for Portfolio Representation
Client authorizes Agency perpetually to feature Client's name, logo, testimonial, and third-party clients on Agency's website and promotional materials for showcasing collaborations and B2B lead generation services.
Liability Limitations
The Agency’s total liability is limited to the amount paid under this Agreement. Neither party will be liable for indirect or special damages. The Agency reserves the right to remove the Client from the system if they see fit for any reason. The Agency is not liable for issues arising from the operation of provided software, including but not limited to Mailead, ReachInbox, Aimfox, Notch, Blue, TaskMagic, SheetMagic, AnyChat, or Unum, such as software discontinuation or technical issues. It is the responsibility of the subscriber to keep track of sending a maximum of 30,000 emails per month for ReachInbox. If you exceed 30,000 emails per month, your ReachInbox account might be suspended until further notice. The renewal date for email sending credits is the 21st of each month. The Agency reserves the right to substitute, add, cancel, edit, or create limitations for any software provided under this Agreement at any time.
Governing Law
This Agreement is governed by the laws of the United States.
Amendments
Changes to this Agreement must be in writing and signed by both parties.
Compliance Statement
The Client is responsible for ensuring compliance with all applicable laws, including the CAN-SPAM Act, GDPR, and other regulations when using the provided software and marketing tools. S Collective Corp has full access to the workspaces provided to the Client.
Dispute Resolution and Legal Action
In case of unresolvable disputes between the agency and the client, arbitration will be used according to state law, with an official arbitrator. If either party initiates legal action to enforce these terms or due to breaches, the prevailing party is entitled to costs and reasonable attorney fees at trial and appellate levels related to the action.
